Labelling Restrictions of Cigarette and Tobacco Products


1. In terms of General Note 14 of this Schedule, the import of cigarette or any other tobacco product shall be the provisions contained in the Cigarettes and other Tobacco Products (Packaging and Labelling) Amendment Rules, 2009, as notified by the Ministry of Health & Family Welfare.

Labelling) Rules, 2008" prescribing the manner in which the health warnings shall be displayed on tobacco products with effect from 31.05.2009.

Additional Duty on Tobacco (Basic excise + NCCD) - Budget 2014 w.e.f. 11.07.2014




Budget 2014 - Cigarettes and other Products of Tariff Heading 2402: Basic excise duty on cigarettes and other products of tariff heading 2402 is being increased. Cause 105 of the Finance (No. 2) Bill, 2014 may be referred to for details. There is no change in NCCD leviable under the Seventh Schedule to the Finance Act, 2001 and Additional Duty (health cess) under the Seventh Schedule to the Finance Act, 2005. Tariff items related to cigarettes of length exceeding 75 mm but not exceeding 85 mm and cigarettes of length exceeding 85 mm are being merged into a single tariff items i.e. others[24022090]. Accordingly, tariff item 24022060 and the entries related thereto are being omitted from the Seventh Schedule to the Finance Act, 2001 and from the Seventh Schedule to the Finance Act, 2005. By virtue of an entry in the Provisional Collection of Taxes Act, 1931, these changes will come into force with immediate effect. The changes in total excise duty rates are summarized below.

Budget 2014 - Pan Masala: Basic Excise Duty is being increased from 12% to 16% on Pan Masala, from 50% to 55% on unmanufactured tobacco and from 60% to 70% on jarda scented tobacco, gutkha and chewing tobacco. Cause 105 of the Finance (No. 2) Bill, 2014 and S. No. 35 of notification No. 12/2012-Central Excise dated 17th March, 2012 as amended vide notification No. 12/2014-Central Excise dated 11th July, 2014, may be referred to for details. - Ed./11.07.2014
