2. First sentence of Paragraph 2.3 will be substituted as follows : - “The prohibition imposed by this Notification shall not be applicable to the export of non-basmati rice if the Minimum FOB Export Price (MEP) is US$ 1000 per ton or Rs.40,000/- per ton.” 3. Transitional arrangements allowed under Para 1.5 of the Foreign Trade Policy, 2004-2009, shall, in public interest, not be applicable to the ban imposed above. However, Para 9.12 of Handbook of Procedures, Vol-I, 2004-2009, shall be applicable (Ref. : DGFT Notification No.89(RE-2007)/2004-2009, Dated 27-03-2008.)

With immediate effect, the following new entry may be inserted after entry at Sl. No.46 of Chapter 3 in Table B under Schedule 2 of ITC(HS) : -

“2.7 Ban on export of wheat shall not be applicable to export of wheat as following:-

3. The quantity of wheat to be exported shall be monitored on a fortnightly basis both by the Customs Department as well as by DGCI&S, through fortnightly reports to be sent to the Department of Commerce / DGFT as well as to the Department of Food & Public Distribution

4. All other provisions of theNotification No.33 (RE-2007)/2004-09 dated 8th October, 2007 shall remain unchanged, and shall continue to apply.
